    I’m a Palm Beach County retired Judge. Back in the late 1980s and early 1990s, I lived in a small waterfront community. We had a strict HOA with lots of stupid picayune rules. After getting some stupid HOA complaints against me, for things like having a boat in my driveway, I got together with some like minded neighbors and got enough votes to allow me to rewrite the HOA bylaws. So I wrote up the greatest HOA bylaws imaginable, and got my buddy, a smart lawyer to have them recorded. No more HOA Nazis and silly rules about the color of our front door or the number of cars you could have.

  • I moved to Florida, first request to the realtor was no HOA! HOAs should have to hold a vote every 4 years to continue. If people want it they can vote to have it.
  • As a Realtor myself, I'm happy with the HOA bill of rights. Some HOAs are OK and some are out of control. You mentioning "power trips" was a good way of putting it.
  • HOA Rule #1....... Don't. Its the only rule I need. Never, Never, Never. My Property is exactly that, MY PROPERTY. Common courtesy dictates decent curb appeal. Beyond that, it's none of anyone's business. EDIT, Y'all seem to be misunderstanding what I said. I'm not talking about keeping your yard neat, cutting the grass, or not collecting derelict vehicles, all that falls under the Decent Curb Appeal I already referred to. My objection to HOA's is because some busybody who ain't paying for my house thinks they can dictate what color I can paint it. What kind of vehicle I'm allowed to buy and drive. What kind of trees I plant. So as long as I have Decent Curb Appeal, It's still MY PROPERTY, Still Nobody's business but mine. And STILL doesn't change my first and only rule for HOA's.........Just Don't.!

    Kinda like all politicians.... the folks that run for HOA boards feel self important, feel empowered to control the actions of others, feel more intelligent and more sophisticated, and lastly absolutely don't feel the individual is empowered to control their own life.

    Thank God I didn’t buy into an HOA community…..I’m in an older established neighborhood that is lovely (yes in Florida). My Sister, however, lives in an HOA community and has been put on the “repeat offender list” for the following DASTARDLY offenses: 1. Her curbside mailbox sits 2” HIGHER than regulation. 2. She had her garage door open while drying clothes (her washer /dryer are located in the garage). 3. The gate to her vinyl privacy fence was left open while she and her husband were carrying bags of mulch to their backyard landscaping. Yes…these are the terrible offenses that prey upon the minds of these HOA **FREAKS***

    HOA should not be able to dictate anything that you own and is within the land that you own! HOA was made to keep neighborhoods looking nice! Not to hand over ownership rights

    One HOA home taught me my lesson - never again. HOAs always become a playground for petty tyrants who love trying to control the behavior of other people. I'd rather have a trashy neighborhood than one with an HOA. At least in a trashy hood one can get with the neighbors and see if there is some way to help them have a cleanup day, with neighbors helping, instead of fines, angry messages back and forth, and property liens. Anyone in an HOA has at least a couple of horrible experiences to relate, and I'm no different. Like I said, once burnt, twice shy; no more HOA days for me, ever.
