Anyone ever try pickpocketing Madesi's ring back from Brand-Shei after you planted it on him, but before the guards get to him and make him turn his pockets out and find it on him? If you steal it back in between those two times, then the ring won't be on him to be found, so no reason for him to be thrown in jail, which was the goal of Brynjolf's scheme.
