    You're wrong Gary and I can explain simply put why. You are missing the principle at stake here which is that the division of powers does not allow the Congress or Supreme Court to criminalize the head of the executive branch. The executive branch is co-equal and that is why the president cannot be brought to account without jeopardizing the entire federal system on which it stands. At best he can be mitigated, but there can't be an actual arrest and prosecution of the president. Technically, the president is not above the law, but there is no court vested with jurisdiction to prosecute him in. That is a critical distinction. If the president can be arrested on orders of the legislative branch, then the legislative branch by definition has overcome the executive. And if the judicial can preside over a prosecution of the president, than the judicial has overcome the powers of the executive. The branches must remain separate.
