India’s three new criminal laws have come into effect starting today. The Bharatiya Nyaya Sanhita (BNS), the Bharatiya Nagrik Suraksha Sanhita (BNSS), and the Bharatiya Sakshya Adhiniyam (BSA), passed in Parliament last December have replaced the IPC, 1860, the CrPC, 1973, and the Indian Evidence Act, 1872 respectively. Faye speaks to senior Supreme Court lawyer Sanjay Hegde and Retired IPS officer Yashovardhan Azad to understand the key changes.

    Our jails are already filled with under trials & now overreach of the police will only increase. Our government should seriously get trained on the protection of the civil rights of Indian citizens.
  • I'm extremely upset seeing this get implemented only hope the courts raise their voice and stop this nonsense they suspended 140 members and passed it without any debate unacceptable to us

    Any law reform suggestions may initially appear to be appropriate but in reality, they require a lot of discussion by the experts (lawyers, judges etc) in various fields including input by the public as to whether the intended outcome will be good or bad and achieve the aim and its impact on the parties concerned. Are there other and better ways and means to resolve the problem need to be examined also.

    Yes implementation of law is different for people with partisan ways then again those people only get benefited. Creating confusion in whole constitution is disaster like demonetization with no big advantages. To use proof of visual aids comes naturally into law for that no need create confusion in whole constitution instead of step by step update of constitution with discussions, anyhow no law is flawless as long as loophole finders in law

    Community sentencing/punishment, if properly understood, is the process of punishing criminals/offenders by having them contribute to the community through activities, usually unpaid. Typically, a court should only hand out a community sentence if the crime is less serious and prison is deemed unnecessary or inappropriate as a form of punishment.

    The question of opposition bringing it up in parliament and opposing it wasnt answered . If they claim they are for the rights of the people, they should. What about issues where personal vendetta plays out either at the police level or police as intermediary. How are they going to make sure that does not happen ?
  • This new Indian law is more like dictatorship form of law, worst than national security law in hongkong and contradicts basic human rights. Where was all of eminent Indian lawyers while framing these dragonian laws???

    Suraj Revanna has been charged under Sec 377 of IPC. But this is absent in BNS. Under Bharatiya IPC rape means man raping woman. There is no man raping man or man raping animal.
  • It seems the objection mostly attributed / due to strengthening the voice & supporting the issues / problems raised / faced by girls / women so as to protect the girl / women, their personal life / rights etc., from any sort of harm, aggression / suppression from any person(s), group(s), institution(s) , aggressors, corners etc. In is know fact that most of the girls, women are the victims of boys, men internally ( within the family members), externally ( outside family members) and both. In some communities, communal groups, conversions, polygamy, etc., boys / men are permitted ( formally / informally) to beat females for various reasons / issues ( though it’s inhuman, illegal , punishable / prohibited by law, etc.). All over the universe gender superiority ( though formally / legally prohibited) has been one of the major parameters leading to formal / informal criminal conspiracies / interference in exercise of fundamental rights, personal rights by girls / women. These news laws may addresses most of such criminal conspiracies / interferences in day to day life of gird / women.
