A crucial link in the Salman Khan 2002 hit & run case, singer Kamaal Khan, has managed to stay away from the limelight for long. But not anymore, as the Kamaal Khan angle has emerged. But where is the singer who was allegedly with Salman Khan on the night of the fateful accident? In a major reprieve for Bollywood superstar Salman Khan, the Bombay High Court today suspended the five-year sentence awarded to him in the 2002 hit-and-run case, admitted his appeal against conviction and granted him bail. Justice Abhay Thipsay directed Khan to surrender beforethe trial court forthwith and execute a fresh bail bond of Rs 30,000. The interim bail granted to the actor hours after his conviction and sentencing on Wednesday was to expire today. While admitting the 49-year-old actor's appeal, the HC said it will expedite the hearing on it and posted the matter for June 15. "This is not a case where I should keep him (Khan) in jail till his appeal is heard and decided. Why his right should suffer when his appeal is admitted and kept pending? In many cases people have suffered and spent their entire prison term only to be acquitted later by the High Court," Justice Thipsay observed. "The normal rule is that when an appeal is admitted and the sentence is under seven years, it (the sentence) is suspended. Why do you (prosecution) want to depart from this norm?" the court said. Justice Thipsay noted that Khan has been on bail throughout the trial even after being slapped with the serious charge of culpable homicide not amounting to murder. "There are a number of arguable points raised about whether or not Khan was driving the car. It is also nobody's case that Khan will abscond if he released on bail, pending appeal," he said. Justice Thipsay directed Khan to seek court's permission before travelling abroad. The prosecution case is that Khan ran over fivepersons sleeping on the pavement in suburban Bandra, where the actor also resides, before ramming a bakery with his SUV on September 28, 2002, killing one person and injuring four. The trial court had on Wednesday convicted and sentenced him to five years' rigorous imprisonment on the charge of culpable homicide and under various other provisions of IPC and other laws. Khan's lawyer Amit Desai argued that the trial court had not considered the defence of the accused that there were four persons in the car, including his driver Ashok Singh, who was behind the wheel at the time of the accident.

    I disagree with you & all the panelists Arnab. It is not because Salman Khan is a celebrity that justice is easy with him. It is BECAUSE he is a celebrity that the case has caught so much attention through the media. If the culprit is an ordinary mortal he simply goes scot free the moment he commits the crime. I am a victim of a hit & run case. When I was crossing the road in a "ONE WAY MAIN ROAD" in Bangalore, a scooterwala came on the wrong side as they always do & hit me. I fell down & lost 3 of my front teeth & was bleeding. After first aid when I went to the police station, they pretended to be very busy suddenly & did not even look at me for 10 minutes when I lost hope for justice & walked away. There was a tender coconut water seller who was the only person ready to come as a witness if necessary. There was a movers & packers company, whose employees helped me in getting up & moving, who flatly refused to come as witnesses. I wouldn't blame them having seen the attitude of the police myself. This happened just last year in Bangalore Jayanagar 9th block in a main road parallel to Bannerghatta road where all the IT companies are located. When I called the cloth shop owner who hit me with his scooter & asked to pay my medical bills, he not only did not say "sorry" but insulted me saying, "Your teeth were very weak. It is not because I 'hitted' you. If you have that kind of teeth they will break & don't blame me for that." I gave up like most of the Indians. When I phoned my house owner in Madras & told her this, she said, "Oh it happens all the time in Madras as well." She said she was on a wheel chair for 1 yr after she was hit by a scooterwala who came on the wrong side of a one way main road. She neither got compensation nor an apology. He also went scot free. This happens in Bangalore (& according to her in Madras as well) all the time. If you stand & count the scooters which come on the wrong side to reach their homes during lunch because they don't want to take the round about way, there will at least be 10 of them in 1 hr. The lesser mortals get completely scot free hitting unsuspecting pedestrians crossing the road, by riding on the wrong side of a one way main road to reach their destinations quickly. There are no CCTV cameras or traffic police in most of the busy main roads because the ministers are busy attending marriages or going on a junket to Brazil. This happens only in India.

    I hit once, but no one died, because I did not run and rather took the victim to hospital, did everything to save his life. He still lives and we are good friends. That is simply being human.

    I like the format of this show and enjoy when I understand the language. However, it is on the contrary to my understanding of the Indian (South Asian) culture where there is an immense respect for the people talking without being interrupted or people communicating with an indirect communicative style - still getting their points across with cool head and more facts. I wish at least each speaker had a chance to complete their thoughts except for the noisy anchor.

  • how about you even did n't mentioned about patel (body guard) who stood up and reported to police and registered FIR (what i heard was true) and he went to jail for not showing up for the case, lost job become drunkard and finally died? even the fact that after 12 year he got convicted and got bail it will go for another decade to hear final judgement. this is the pathetic situation in INDIA. In my life time i don't understand on what basis cases after judgement from lower court, system will allow cases to retried in high court and then SC. ( with out a valid reason to show injustice happened how come they allow to go to high court)

    Sonu Sood clumsily and carelessly spilled the beans. Mr. Kamaal Khan was indeed hanging out in Mumbai for much of the time that this case was going on. Manyank also too good.
