I won $30 million at trial, but the Judge knocked it down to $3 mil! What gives?!

    Vince, I got my RTS, and my attorney said he's writing up a proposal for the 4 partners, and they have to take a vote. I'm nervous. Should I be looking for another lawyer? It's been 30 days, and I've heard nothing yet.

  • As a mathematical person, I would love to see how attorneys calculate both pecuinary and non-pecuniary damages. Do you all use a spreadsheet or some kind of software, or other tool?

    I’m in the middle of a EEO now and my case has been selected for early mediation. Now I don’t think I’m going to get $30M let alone $3M. My company legal department has placed me on a “legal hold” and asked to meet with me. Would I be considered “difficult” if I declined.
  • So, can you explain the formula? I would actually be rational with applying it. Assume we're reasonable.

    Vince you can argue "the formulae" is not based on Federal anti discrimination law. Yes there is a cap of $300,000 under the 1964 Civil Rights Act. But no "formulae" is written by Congress. And there are no caps under section 1981 of the 1866 Civil Rights act. So if a Jury awards 30 million in damages to a complaining party under these statutes then they should get their money!
  • Plaintiff (employee) gets a legal jury award of 30 million. The plaintiff won. Why is the defendant not required to file an appeal at this point? Why is the burden shifted to the plaintiff when the plaintiff prevailed?
